Welcome to The Gist, a product of Loomworks ("we," "us," or "our"). By accessing or using The Gist at gist.loomworks.io (the "Service"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service.

1. Nature of the Service

The Gist is a pre-commercial demonstration of a personalized daily newspaper built from publicly available RSS and Atom feeds. The Service is provided on an "as-is" and "as-available" basis for evaluation purposes. We make no guarantees regarding uptime, data retention, or continued availability.

2. Eligibility

You must be at least 16 years of age to use the Service. By creating an account, you represent that you meet this requirement.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and current information when creating your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Interfere with or disrupt the integrity or performance of the Service.
• Use automated tools to scrape, crawl, or extract data from the Service beyond normal RSS consumption.
• Impersonate another person or misrepresent your affiliation with any entity.

5. Intellectual Property

The Gist aggregates and displays content from third-party RSS feeds. All article content remains the intellectual property of the original publishers. Loomworks claims no ownership over third-party content displayed through the Service.

The Gist name, logo, design, and original software code are the property of Loomworks and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from these materials without our prior written consent.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Loomworks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service.
• Any conduct or content of any third party on the Service, including content from RSS feeds.
• Unauthorized access, use, or alteration of your transmissions or content.

7. Disclaimer of Warranties

The Service is provided "as is" without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Loomworks does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

8. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
